The privacy of our clients is important to us. We are committed to protect and safeguard any personal data you give us. The below Solargis Privacy Policy (hereinafter as “Privacy Policy”) describes how we use and process your personal data and what are your rights and possibilities with respect to such processing. You will also find here information how you can contact us if you have any questions about your personal data.
This Privacy Policy is connected with Solargis Website Terms of Use available at https://solargis.com/legal/website-terms-of-use. Expressions used in Capital letters, unless expressly defined herein, have the meaning attributed in the Website Terms of Use.
Personal data
We receive and store information that you voluntarily provide when using our Websites and Services. Despite the fact that our Services can be purchased exclusively by entrepreneurs, professionals, governmental institutions, agencies and other institutions, whose data should not be considered as personal data, it may happen that you may provide us also with some of your personal information including your name, email address, working position, telephone number or other basic contact information (e.g. when you establish Customer Account or User Account at our Websites or when you postulate for job openings, as the case may be). You may also happen to provide additional personal information to us when you voluntarily communicate with us, such as when you request information through our contact form or register for newsletter.
Purpose of processing and legal basis
Primarily, we use the personal data that we receive from you to provide information and perform Services that you request. The legal basis for such processing is the performance of a contract and/or the adoption of steps at the request of the data subject prior to entering into a contract (pre-contractual relations).
Data included in the payment documents (invoices) and other tax-related and accounting records are processed on the basis of the law requiring record keeping (such as income tax and VAT tax laws and/or proper accounting requirements). To process your payments, we use third-party payment service providers, such as PayPal, Stripe. These third-party payment service providers collect information from you to process a payment. Solargis does not receive or store your payment information.
If you are a contact person of the Customer or potential customer, the legal basis for data processing is also our legitimate interest to process personal data of contact persons for the purposes of entering into the contract, fulfillment of contract or enforcement of the contractual rights and obligations. The legitimate interests as legal basis apply also when we verify if contract terms and conditions are observed.
If you are a Customer or a contact person of the Customer, the legal basis for the processing is also legitimate interest to process personal data for the purpose of establishment, exercise or defense of legal claims. Once the claim has been submitted to the respective court, arbitration court or another competent authority, the legal basis for the processing is also law governing such proceeding.
In addition, we have also legitimate interest in using your information to improve our Websites and offered Services.
If you sign up for our newsletter, we process your personal data for marketing purposes with your explicit consent as a legal basis. You can revoke such consent at any time by sending an email to contact@solargis.com or by clicking on the “Unsubscribe button” offered directly in each newsletter. In case of revocation of the consent, we will immediately stop processing the respective personal data and delete it, unless there is another legal basis for its further processing (maintenance of data of subjects who rejected direct marketing for the purposes of proving compliance with the applicable law). However, any processing performed before the revocation of your consent remains lawful.
If you are our Customer or have User Account with us we may send you information on our products and services in accordance with applicable law (law on electronic communications, data protection). You may opt-out from such communication following the instructions provided with the information sent.
If you are a candidate to job openings published on the Websites, by replying to one of these postings or otherwise you provide us with your personal information. We will collect and process the information you provide to us only for this purpose and only in accordance with applicable law. For more information see our job application policy.
Cookies and similar technologies
We use common website management technologies called cookies and similar technologies, which have different functions.
A cookie is a small data file, which often includes a unique but non-identifying code that is sent to your browser from a website's computers and stored on your computer's hard drive. Cookies allow you to be recognized as the same user across the pages of a website. Cookies also allow your choices to be remembered – choices such as the language you prefer, the currency you use and your search criteria. We ask for your consent with cookies use, unless cookies are necessary for proper operation of our Websites (essential cookies), in which case it is a legitimate interest for their use. You may allow or dismiss other than essential cookies via cookies banner which also includes information on concrete cookies, their purpose, retainment duration and settings options.
We work with third-party companies, who are authorized to place third-party cookies or similar technologies for storing information on our Websites with our permission. Retention of your personal data
In broad terms, we will only retain your personal data for as long as is necessary for the purposes described in this Privacy Policy chapter. This means that the retention periods will vary according to the type of the data and the reason that we have the data in the first place. We have procedures in place regarding our retention periods which we keep under review taking into account our reasons for processing of your personal data and the legal basis for doing so. Usually, the contract-related personal data are retained for the duration of contract and 5 years after contract termination, mainly for the legal or accounting/tax related requirements and 4 years for the purpose of establishment, exercise or defense of legal claims. Cookies are retained usually for session duration (i.e. for as long as you use our Websites) unless cookies settings and information state otherwise.
Share and transfer of personal data
We will never sell any of your personal data to a third party. In order for us to provide our services to you, we however share your personal data with our trusted third party service providers, e.g. authorised payment providers such as First Data Slovakia, s. r. o. or PayPal (Europe) S.à r.l. et Cie, S.C.A, provider of email address verification services Byteplant GmbH Software Solutions & Consulting, the Rocket Science Group for Mailchimp® services or Zoho Corporation BV, whose services we use for purpose of managing and organising communication with prospective and existing Customers. We may exceptionally share your personal data within the Solargis group entities and only by adhering to all regulatory legal requirements. We do not expect any our suppliers to transfer personal data outside the EEA, however, should any such case occur we would request appropriate safeguards as if it were being processed inside the EEA. We take the security of your personal data very seriously. We use appropriate procedures to protect and safeguard the personal data you give us. We have put in place security systems designed to prevent unauthorized disclosure of information you provide to us. These systems are structured to deter and prevent from accessing this information.
